Retreat Terms & Conditions

I am participating in a health and wellness retreat (“Retreat”) that includes yoga and other wellness practices, which may involve physical movement, exercise, health, nutrition, and spirituality. I understand that some of these activities require physical exertion, which may be strenuous and could cause physical injury, and I am fully aware of the risks and hazards involved.

I acknowledge and agree that it is my responsibility to consult with a physician prior to and regarding my participation in this Retreat. I certify that I am physically fit and have no physical, mental, medical, or emotional illness or condition, or take any medication or drug that would prevent my full participation in this Retreat.

In consideration of being permitted to participate in this Retreat, I hereby assume full responsibility for any risk, injury, or damage that I may sustain as a result of my participation in, or any instruction received during, any session of the Retreat.

Further, on behalf of myself, as well as my heirs, beneficiaries, and/or legal representatives, I hereby knowingly, voluntarily, and expressly waive any claims I may have against, and forever release, waive, discharge, and covenant not to sue, the Teachers, as well as any landlord, host, or sponsor at any location where this Retreat is taught, in connection with any injury, death, loss, or damages that I may sustain as a result of participating in the Retreat.

It is specifically understood that the Teachers, as well as any landlord, host, or sponsor at any location where this Retreat is taught, shall not be responsible or liable for any of my personal property that may be damaged, lost, or stolen.

In the event of any dispute between me and the Teachers, and/or any other third party relating in any way to this release agreement, I agree that venue for any legal action or proceeding shall take place exclusively in the federal and state courts located in Maricopa County, Arizona, which shall be deemed a convenient forum, and I hereby submit to the personal jurisdiction of such court(s). I also agree that any such dispute shall be governed by and construed in accordance with the laws of the State of Arizona, excluding any choice of law rules.

This Agreement sets forth the terms and conditions regarding the non-refundable deposit and refund considerations for the purchased retreat (“Retreat”) organized by the party and/or parties Donny Starkins and/or Serve Big LLC (Organizer”). By participating in this Retreat and providing a deposit, all participants ("Participants") agree to be bound by the terms stated herein.

Non-Refundable Deposit: Participants acknowledge and agree that the deposit paid to secure participation in the Retreat is non-refundable under any circumstances, whether due to withdrawal, cancellation, or other reasons.

Refunds Based on Force Majeure or Extenuating Circumstances: Refunds beyond the non-refundable deposit may be considered only in the event of force majeure or extenuating circumstances. Such circumstances may include but are not limited to acts of nature, government-imposed restrictions, or other unforeseeable events that directly impact the feasibility of conducting the Retreat.

Notification and Presentation of Refund Requests: Participants seeking a refund due to force majeure or extenuating circumstances must provide written notice to the Organizer no later than 30 days prior to the scheduled start date of the Retreat. This notice should include a detailed explanation of the circumstances and supporting documentation as evidence of the claim.

Organizer's Discretion: The decision to grant a refund based on force majeure or extenuating circumstances is solely at the discretion of the Organizer. The Organizer reserves the right to assess the validity of the claim, the impact of the circumstances, and the feasibility of accommodating the refund request.

Refund Amount and Processing: In the event that a refund is approved, the refund amount will be determined by the Organizer based on the circumstances and the amount paid by the Participant, less the non-refundable deposit. Refunds, if granted, will be processed within a reasonable time frame as determined by the Organizer.

No Refunds for Failure to Attend: Participants who fail to attend the Retreat without providing notice or meeting the conditions outlined in this Agreement are not eligible for any refunds, regardless of the reason for their absence.

Amendment and Modification: This refund policy may be amended or modified by the Organizer at its sole discretion, and any such changes will be communicated to Participants in a timely manner.

By participating in the Retreat and submitting the non-refundable deposit, Participants acknowledge their understanding and acceptance of the terms and conditions outlined in this Agreement. This Agreement supersedes any prior agreements, understandings, or representations, whether written or oral, between the Parties regarding refund considerations for the Retreat. IN WITNESS WHEREOF, the Parties hereto have executed this Agreement as of the date first above written on the original purchase.

I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above.
